Guys/Gals,
Do you know that if i become a named Plaintiff in 485 fiasco lawsuit and the lawsuit drags for a Year ( just vague timeline) does that imapairs my ability to file a fresh new 485 application if my PD becomes CURRENT ?
I'm also assuming that USCIS would not return my Package sent on July 2nd since i'm the middle of a live lawsuit as a plaintiff.
Thoughts ? Knowledges ?

hi everyone
I m an MBA(major:general mba)student in a university in texas. I have an bachelors of engineeing (electrical & electronics)from india. I have found an desi employer who is ready to train me in SAP (FICO)functional and than place me on projects to diffeent companies. Since i m graduating in august 2008 ,At first i have to work for him on OPT and than in apil 2009 my employer will sponcer my h1 visa.
Now my question is....
1) can i work in SAP FICO functional , when i m on my opt?(opt means i have to work in a job directly related to my major field of study and i guess SAP is not related to my field major field of study)
2)will i have problems getting a h1b visa? (since General MBA and SAP are completely different fields )
Any comments or suggestions will be appreciated.

I agree that an error in name order on an EAD is not likely to cause any major problems. However, You can apply for a replacement card by filing another I-765. If the error on the EAD is due to a USCIS mistake, no fee is required. However, if you caused the error by providing incorrect information, then you will have to pay the full $340 filing fee again.

I have never been to the meeting but will like to attend one if scheduled in future. i think its high time our Chapter schedule meeting with Senators/Congressmen in this area including MD, VA and DC. The President has started the immigration reform initiative and it is right time to make the lawmakers aware of our EB issues. Let me know your thoughts.

US rolls out new online visa form in India

NEW DELHI - With the demand for US visas surging by the day, the US embassy and its consulates in India have introduced a new online non-immigrant visa (NIV) application form to cut out needless delays.
The DS-160 form will be online on the website of the US embassy from Jan 19. For all NIV visa appointments starting Feb 1, applicants will need to fill out the DS-160 form, the US embassy said here Wednesday while announcing the introduction of the new form.
The new form, that leverages new technologies, is expected to cut processing delays as applications could be pre-processed and pre-screened before an applicants interview.
Applicants will continue to complete visa application forms online, as they did previously with the Electronic Visa Application Form, the embassy said.
The demand for American visas has been escalating in India over the years.
The four US consulates in the country had processed 725,000 visas in 2007 - a 58 percent increase from 2006.
India is among the top 10 countries sending visitors to the US.

My I-140 was filed via regular processing then later shifted to premium processing in Aug 2006, approved in Oct 2006 Nebraska Center and was received at the NVC in December 2006 and given an NVC Case number.
I know someone who has a priority date of june 2006 and I-140 approved last january 2007. The document is not yet received by the NVC.
Which one will the NVC process first? My papers that was received by the NVC first. Or will it still follow the priority date?

Seeing the enthusiasm of all the people on this message board, I would like to request IV Core to co-ordinate rallies in various cities by doing the following:
1. Facilitate a common date for all rallies through consensus
2. Facilitate the development of a common theme through consensus
3. Facilitate an official statement on our position on "employers that abuse the immigration system"
I propose that the San Jose rally organizers should act as advisors to other local chapters since they did a wonderful job organizing the rally.

It's really hard to get visa. You should hold green card to bring your spouse to united states or else its tough. Maybe you can ask your wife to come through F-1 visa, you both can purse your studies and also stay together. The other option is to go through visitors visa, but in inteview they might ask questions make sure you people answer honestly.

I have received all the receipt notices for I-485/AP/EAD for myself/wife.
Situation is this:
My current H1B expires on the 30th of September 2007 and I have applied for 3 year extension under premium processing last week.
If for whatever reason my H1B extension is denied then what are my options? First off, would it invalidate my I-485 application as it is employment based.
I believe if the answer to above is no, then I can just use my EAD and continue working.
Thank you for your time.

Thansk visakk for your reply, I am travelling thru same employer only. He still wants me to come there. Looks like he is confident & is certainly going to give me Revised Offer Letter dated in Feb 2010.
However my main question is still unanswered whether the scenario is correct to travel, considering January 8 guideline issued by DHS/USCIS. And Subsequent Deportation incidents.
I have option to travel on L2 as well. As my spouse is having L1 visa and she is going to travel in March.
But I want to be on H1B, Pleasse enlighten me on this.

1. What is the exact filing fee ? The latest I-131 instructions have this note -
NOTE: If you filed a Form I-485, Application to RegisterPermanent Residence or Adjust Status, as of July 30, 2007,no fee is required to also file a request for advance paroleon Form I-131. You may file the I-131 concurrently withyour I-485, or you may submit the I-131 at a later date. Hmmm... your attorney needs to spell out exactly what the risk is.
Cross chargeability is a perfectly legal thing to do while applying for your green card. So as long as you have your papers in order, not sure what the problem is.
Ask him for details and maybe you should get a consult with another good attorney who's getting paid by you (not your employer) to make sure you aren't getting ripped off.

My father passed away recently and my mother wishes to travel with my wife and I on a visitor visa.
How can she apply for 10 year multiple entry visa? Can she return after the visa expires, after a month? Any experiences anyone can share? Are there any reasons why some visas get denied?
My wife and I are permanent residents and we want to know whether this is of any advantage/disadvantage.
Any pointers/info/help are much appreciated. I looked through the relevant IV threads and yes, they are informative but rules change all the time and I decided to just go ahead and post this thread to get the latest feedback.
Has your mother gotten US visitor visa before? The most important point is to prove to the consulate that your mom will return back from USA. To prove that you need to show some strong ties in your home country. Now that she is a widow it can work against her unless your siblings are still in india. All other things are secondary.
The number of years for the visa can range from 3 months to 10 years and it depends on how strong your mother's case is.
