    This must be the worst immigrant experience I have heard.
    I am sorry to hear that you have to go through this. You must approach social workers' group in your local area. They will help you get proper treatment from reliable sources, and they will also appoint you a lawyer if you cant afford one.
    Dont let that loser off the hook. Despite of all emotions involved in this case, go after him hard and square. Make him pay for what he did to your daughter.
    I dont know about your GC process, for which consulting an immigration lawyer is the best thing to do, right now you have a much important issue at hand than just a green card.

    Right now Atlanta Processing Center processing May 2008 priority date for clean cases....for audited cases July 2007...
    It's not true that all the cases will got to Atlanta Processing Center ...if any case that has been auidted will be moved to Atlanta Processing Center.

    I have current passport with valid I94, my lawyer asks for copy of all expired passport which has visas on it. But I ccannot find the expired passport, can I still file the I485. I appreciate your help.

    Better give them both there is no harm, because they are gonna check the validity period on them.

    But u can ask a attroney, that was my opinion.

    But all cases should be processed by priority dates and the services centers should show the I485 EB catergory cutoff dates instead of the processing dates.

    also try taking appointment by sending someone to the mumbai office. only a portion of the appointments are available on the internet. you can get a better date by taking a local appointment. it can be taken anywhere where there is VFS office (pune etc) if mumbai is not a convenient place for you. this was the case around 3 years ago, i dont know if it has changed now, but worth exploring the option.

    We will be travelling to India and are looking to book Visa appointment. In Mumbai only first week of december is available. As we have to mail the documents, first week of december is not an option for us.

    Has the Mumbai consulate opened the dates for December 2nd week and further or has the appointments been booked?

    Unfortunately, the only solution is to take your camera to a Nikon repair center. It seems that the D2H's meter failing is alarmingly common, from what reports one reads online. If your camera is yet under warranty, then you're in luck. Otherwise, it may be a US$200 - $300 repair. :(

    Usually I-485 processing time is 6-9 months. If your PD is current and filed before March 26 2009, you can call and find out your petition status.

    I-485, EB visa processing time for TSC is showing as Mar 26 2009. is it going to be true or typo?

    I am going to complete my 6th year on H-1b, this year end. My I 140 is cleared and I am going to file for 3 years extension. In the beginning of this year, for 3 months pay stubs are not run, due to some personal reasons. Will this affect my renewal of H1. We need to submit 3 pay stubs, before applying for extension. There will be a shortfall of YTD, when compared to actual. Please share your thoughts, who have clear understanding on these. thanking you.

    We still in negotiation. not come to a stage where EAD has been asked for. i am wondering what else could they ask for other than EAD like do they need to provide any proof that they will sponsor my green card or do i need to file AC21 in advance.

    It all depends on Company. Most of the companies they just see EAD and take you.
    If that company has dedicated IMM people and IMM knowledge they might ask you for more information and they just want to make sure they don't need to support you when needed.
    You know it all depends and varies form company to company.

    Returning to the US after living abroad for 9 years and need to know what is the best process for my wife to re-apply for green card.
    History:
    My wife and I have been married for 20 years, own a home in the US and have one child who holds a US passport. While living in the US my wife held a Green Card. However, when we moved she surrendered the card. Now we are returning to the US and she need to get the Green Card once again. Does she need to apply as if this is the first time or is there an application or process for previous residents or Green Card holders?

    Thank you for any and all help you can provide.

    I94: The number should be same for all. You need a copy of most recent one. Although, layers have been taking copies of all I94s. To be on safer side, you can send copies of all I94s.

    AP: You can travel on valid AP. Return before it expires.

    Renewd AP: It will have new valid dates. When you get this (in USA) then you can use it for travel. I am not sure whether it is OK or not OK to tell friend to mail it in your country of visit and try to come back on this.

    Today I will be giving a presentation on immigration law along with my colleague, V. Thomas Langford, to the Air Force JAG serving at Travis Air Force Base in Fairfield, California. The Air Force JAG Corps are lawyers who provide legal advice to those serving in the Air Force.

    Our training today will focus on the basics of immigration law. We will be covering family-based immigration law and outlining the procedures involved in petitioning for a family member to immigrate to the United States. We will also be talking about the Violence Against Women Act ("VAWA") and how an individual may self-petition for immigration status if he or she has been the victim of abuse or mental cruelty. Finally, we will discuss the naturalization laws as they apply to those serving in the military at a time of a conflict.

    It seems that I always learn something while preparing for a presentation. While preparing for this one, I learned that staff from USCIS in Sacramento go to Travis Air Force Base twice a month to interview applicants for naturalization and administer the oath of citizenship on the same day. Kudos to USCIS for taking the time to do this. USCIS has an entire website page devoted to military naturalization ceremonies (http://www.uscis.gov/portal/site/uscis/menuitem.5af9bb95919f35e66f614176543f6d1a/?vgnextoid=7b309f22ae951210VgnVCM1000004718190aRCR D&vgnextchannel=0a9ab58f71e14110VgnVCM1000004718190a RCRD) performed in May 2009.     MSNBC had a news piece on surprise illegal immigrants and looks like they are from India. I was surprised at a shocking 125,000 people have over stayed their visas and have become Illegal. I was worried if such news articles will reflect on our integrity and our image as knowledge workers.

    Just a thought....

    While we can keep an eye on these articles - these are coming up to counter our efforts.

    Lets keep the focus on.

    I would only say - IV is for legal immigrants, for those who have maintained legal status and have played by the rules.
