Its at the discretion of the officer at POE.......I was asked for my EAD even when I had a valid H1B and last time when I had travelled on AP I was asked for my EAD......
why don't you apply for duplicate documents with the USCIS?

I've found this site to be very helpful so far and would like to ask for some opinions on my case.
My I-485 (EB2) was submitted in 2007 and the PD is approaching, only 5 days away based on June's VB. My girlfriend is currently with F-1 visa and we are planning on getting married asap so that she can submit her 485 before my case is approved.
Here's the complete list that I can think of based on the research that I've done.
Documents that my future wife's need prepare
I-485 form
birth certificate
marriage certificate
medical exam
passport pages (I-94 card ect)
I-20 form
Two photos
Documents that I need prepare
My I-485 receipt
????

It is very important to get married before your GC is approved. Even if you are 1 day late, you cannot file I-485 or follow to join. So its better to get married before June 1st to remove any such risk. Good luck!

Myself(Husband) & mywife both came on H1B from same employer.
My son got H4 visa through my wife H1B visa.
I (Husband) applied for green card and got EAD for myself & mywife , got Advance parole for myself, mywife & myson and are in 485 pending AOS status,
My Wife is taking permanent job with EAD (EAD is through my Greencard process)
If employer cancels my wife H1B she will come to EAD status.
I am not sure what will be the status of my son who is currently on H4 visa through my wife H1B visa.
My son got Advance Parole and 485 pending status through my green card.
Do I need to apply for H4 visa for my son or will my son be ok on pending AOS status ?
His status is AOS. Unless a decision is made on your GC he needs no other visa or documentation to be in USA. If your GC application gets denied (Should not happen ever) then you lose AOS and you will have to talk to an attorney to see how long you can be in US - for the sake of filing an MTR etc.
Once a person files for 485 and application is pending a decision they can be in US without a VISA. If you travel outta US and needs re-entry that could be done useing AP. Hope this helps........

I received an email from my lawyer on 26th June 2007 that they have received my approved labor certification in mail today. I got my medical examination i.e. form I-693 performed on June 23rd 2007 and received the results on June 25th 2007. I have already filed my I-485. Will it be a problem since I have got my medical test done a few days before receiving my labor certification.

I am trying to get a green card for the US. My parents are from east asia and I was born in Canada. I went to University in Maryland from 1992-96 and obtained my dental license. I am licensed in the US and intend to purchase a dental office soon. I will still be keeping my dental office in Canada for at least 1 year once I am able to work in the US. I heard about a investment visa however I am not investing more than $400k but it will employ at least 4 US nationals(ctizens). Can I still use the investment visa or can I get a visa for opening a secondary dental office in the US and still keep my existing office in Canada until I qualify for a green card. If you want to change your location of FP appointment then you can do your FP at any location on W E D N E S D AY only(walk-in's allowed).....other weekdays for appointment people only..........tha't what USCIS customer sevice said..
but some ASC's are accepting weekday walk-in's also.................
It's not necessary to to go on the same day and same time at different location........you can go any wednesday before your appointment date.

by filing that I-140 that LC became yours and so now you have that one year old LC that you need for the 1 year extension.
When premium processing opens up, you may want to upgrade your I-140 to premium and get the 3 year extension instead, up to you
if you have one I-140 pending, the second one cant be made premium, but can still be filed in regular.

You are looking at a old document. The I-94 copies were asked back in 2008 to identify that you are in fact at or beyond 6th year on H1. Now all you need is the latest I-94 and form I-907 along with I-140 original labor certificate to do premium processing.
Now there are no restriction, any one eligible to file I-140 can do premium.

I recently came back from India, and got a new I-94 at port of entry, but later I noticed that CBP officer added 10 more days to my I-94 expiry(it may be a mistake by the officer)

A word of warning: If for any reason the US Consul in Canada denies your visa application, you will not be permitted to return to the US until you go to India and get an H visa.

I just want to confirm that this ruling is still in effect. Use AP to return as Parolee, never used EAD, can continue to work for same employer on approved H1B petition. Are there others in this situation as well?
